Legal Specialist
Группа реализация проекта “Восстановление устойчивых лесных ландшафтов в Узбекистане” при Агентстве лесного хозяйства Республики Узбекистан, Ташкент
Responsibilities: Support the PIU staff and its advisors to prepare the relevant legal sections of the bid documents (RFB/RFQ/RFP/CQS/QCBS Contract) and review the information prepared by PIU Authority and/or its advisors with regard to its legal aspects; Assist PIU manager in preparing Agreements/Contracts, Memorandum, Information on legal aspects of transactions and etc.; Track amendments to any procurement documents and assist in incorporating changes accordingly; Review and provide opinion on all relevant laws, policies, statutes, regulations, and licenses. Highlight restrictions / limitations under any statute / law; Identify and investigate litigation, suits or third-party claim (i.e. from revenue authority etc.) for any PIU activity, if any; Initiating the updates and contributing to the Project Operational Manual amendments; Prepare IFI Project docu ments on review of regulatory documents to organize Project implementation; Prepare legal proposals for amendments to legislative and regulatory acts aimed at successful implementation of project objectives; Advising on and directly contributing to the Project management scheme / adjusting the Project legal framework setup; Drafting and processing legal documents, including drafts of the laws, by-laws, legal opinions, and other legal acts and documents; Participate in the negotiation and execution of contracts with contractors, consulting firms and suppliers, as well as in the work of the tender commission; Liaise with project procurement specialists in contracting with local and international contracting organizations, consultants, suppliers and monitor legal and compliance in contracts related to Project implementation; Provide legal advice in various areas of national legislation to foreign consultants; Perform other legal tasks as assigned by the Manager. Requirements: Advanced university degree (Master’s or Bachelor’s degree or equivalent) in law with 3 years of relevant experience; Relevant experience is defined as experience as a lawyer/counsellor in commercial or international law, including legal analysis, advice, research or drafting of legal texts; Experience relevant for the position in the World Bank projects or other donor funded projects is highly preferable; Knowledge of English, Uzbek and Russian languages, Computer proficiency (Windows, MS Office, Internet Explorer). Additional information The Government of Uzbekistan received loans from the International Development Association (IDA) for the implementation of RESILAND CA+: Uzbekistan Resilient Landscapes Restoration Project (hereinafter Project). This project will finance priority policy, institutional, and infrastructure activities at both the national and regional levels, to promote sector sustainability and accelerate progress towards achievement of the Government's development objectives. Moreover, the programmatic approach will support the ongoing sector reform process through comprehensive and consistent support to address existing challenges and constraints more broadly including support to performance improvement process; strengthening the central-level policy and planning framework; and institutional capacity for monitoring and regulation. The Project Development Objective is to: increase the area under sustainable landscape management in selected locations in Uzbekistan, and promote Uzbekistan's collaboration with Central Asia countries on transboundary landscape restoration. This PDO is uniform across the RESILAND CA+ Program projects, however, with varied sustainable landscape management practices based on country-specific context. For Uzbekistan, sustainable landscape management refers to tree-based restoration practices on SFF land in landscapes within six defined transboundary corridors. Such practices include agroforestry (intercropping with trees, shelterbelts); improved grazing land management through temporal enclosure and enrichment planting; plantations and reforestation, (production-oriented plantations, tree belts for protection of catchments and erosion control); PA management; soil fertility and water harvesting measures to support tree systems (including adopting techniques such as hydrogels); and other relevant sustainable landscape management practices that are tree-based. Sustainable landscape management related interventions will be carried out by the government, forestry enterprises, the private sector, and rural communities, in the targeted locations within the Project corridors. In accordance with the Financing Agreements, the responsible entity for the Project implementation is the Forestry Agency under the Ministry of Ecology Environmental Protection and Climate Change. The Project Implementation Unit (PIU) established under the Forestry Agency is responsible for overall Project coordination and reporting. The PIU will be responsible for the provision of assistance to the Forestry Agency in implementation of the Project in procurement, financial management, and other aspects to the extent required, in direct communication with the Bank. The Forestry Agency acts as the Client and is responsible for the implementation of the project, including the execution of works, project management, procurement, security, etc., as described in more detail in the Project Operational Manuals. The objective of this activity is to support the PIU Authority in preparing the relevant legal sections of the Uzbekistan Resilient landscapes restoration Project documents and review the information prepared by PIU Authority and/or its advisors with regard to its legal aspects in undertaking PIU projects. S/he will continuously interact and liaise with project stakeholders and ensure that only quality documents are presented.
